Car rental agreement: the clauses you should not forget
A clear rental agreement prevents most disputes: a withheld deposit, a fine that arrives weeks later, a scratch contested at return. Here are the clauses every rental business should include, for cars as well as vans or equipment.

1. The parties
Identify the rental company and the renter precisely. For the renter, record their ID and driving licence details (number, country, expiry date), plus any authorized additional drivers.
- Company name, address and contact details
- Renter's name, address, phone and email
- ID and driving licence: number, issuing country, expiry
- Additional drivers, with the same details
2. The vehicle and its condition at pick-up
Describe the rented vehicle and its condition when the keys are handed over. The agreement should refer to the pick-up inspection report signed by both parties.
- Make, model, licence plate (or serial number for equipment)
- Mileage or engine hours at pick-up
- Fuel level at pick-up
- Reference to the inspection report and pick-up photos
3. Rental period, location and return
State the pick-up and return dates and times, the pick-up and return locations, and what happens if the vehicle is late: fees per extra hour or day, and from when they apply.
4. Price, extras and security deposit
The total should be understandable without a calculator: rate applied, extras, any mileage limit and the price per extra mile or kilometre. For the deposit, state the amount, how it is paid, and when it may be withheld in whole or in part.
- Rate (daily, hourly, seasonal) and total amount
- Extras: additional driver, child seat, GPS…
- Included mileage and price of extra mileage
- Deposit amount, withholding conditions and refund timing
- Down payment received and balance due
5. Insurance and liability
Explain what the vehicle insurance covers, the excess (deductible) left to the renter, and what is not covered (for example an unauthorized driver). Insurance rules depend on the country: have this clause checked by your insurer.
6. Conditions of use
- Only named drivers may drive
- No subletting or paid passenger transport
- Authorized area (cross-border trips, unpaved roads…)
- Fuel policy: returned at the same level, or charged
- No smoking, and rules for pets
7. Traffic fines, tolls and fees
State that fines and tolls incurred during the rental are the renter's responsibility, and how you handle them: transferring liability to the driver with the authorities, or recharging them, possibly with an admin fee. Keeping the date, time and vehicle of every rental lets you find the right driver weeks later.
8. Damage, accidents and breakdowns
Describe what to do: notify the company immediately, fill in an accident report, take photos, and do not repair without approval. Include the roadside assistance number.
9. Personal data and signatures
Explain how the renter's data is used (managing the rental, legal obligations) and how long it is kept, especially if you are subject to GDPR. Finish with the date and both parties' signatures, on paper or electronically.
Frequently asked questions
Is this guide legal advice?
No. It is a checklist of points to cover. Rules on insurance, consumer protection and personal data vary by country: have your template reviewed by a professional.
Is an e-signed agreement valid?
In many countries, yes, but conditions vary. Check the rule that applies to you.
How do I avoid rewriting the agreement for every rental?
Use a template filled in automatically with the client, vehicle, dates and price. Flotway does this from your own terms and produces a PDF ready to sign.
